SUBJECT:     An Ordinance of the City of Hallandale Beach, Florida, Amending the City’s adopted Comprehensive Plan, Future Land Use Element, Section 2.3.H Relative to the Use of Flexibility or Reserve Units within the Local Activity Center Land Use Category Providing for Conflict and an Effective Date. (This Ordinance is a result of Application # 38-10-PA by the City of Hallandale Beach) CAD#018/06

PURPOSE:   

 

City Commission adopt on First Reading an Ordinance of the City of Hallandale , Florida, Amending the City’s adopted Comprehensive Plan, Future Land Use Element, Section 2.3.H Relative to the Use of Flexibility or Reserve Units within the Local Activity Center Land Use Category Providing for Conflict and an Effective Date.

 

BACKGROUND:      

 

On March 24, 2010, the Ordinance was presented to the Planning and Zoning Board which recommended approval by a majority vote of 5-0. Please refer to the attached staff report to the Planning and Zoning Board for a full technical analysis.

 

DISCUSSION:          

 

The City’s present  Local Activity Center (LAC) qualification criteria requires the City to utilize 75% of available flexibility units and /or reserve units to address proposed increases in residential density. This criteria was consistent with the Broward County Comprehensive Plan requirements for Local Activity Centers (LAC) at the time the City initiated adoption of the LAC land use.

 

The County has since eliminated this criteria due to their concern that this requirement penalized local governments for designating Local Activity Centers by reducing their ability to utilize flex to promote redevelopment activities in other areas of the jurisdiction.

 

CONCLUSION/RECOMMENDATION:

 

The City Commission approve a First Reading on the attached Ordinance and schedule Second Reading for the May 5, 2010 Commission meeting.
