BID SUMMARY COMMENTS

The following comments relate to the '*' items in numerical order indicated on the Bid Award Summary Memorandum.

The 35th Year CDBG Public Works Improvement Project involves public works and utility infrastructure improvements including drainage improvements, sidewalks and landscaping.
The project is located in the Southwest Area and the boundaries of the Project area are as follows:
· Hallandale Beach Blvd., SW 4th Street, SW 4th Avenue, and SW 2nd Avenue

On 01/25/2010, fifteen vendors submitted bids for the 35th Year CDBG project: Tran Construction ($218,341.00), Miguel Lopez Jr., Inc. ($269,453.00), J.B. Builders and Contractors, Inc. ($290,888.32), Florida Engineering ($308,277.10), Sun Up Enterprises, Inc. ($315,238.00), Straightline Engineering ($317,826.00), Tenex Enterprises, Inc. ($324,179.00), Horizon Contractors, Inc. ($337,293.00), Acosta Tractors, Inc. ($348,889.56), American Engineering & Development Corporation ($351,572.00), Johnson-Davis, Inc. (359,473.00), William Paving Company, Inc. (384,640.00), JVA Engineering Contractors, Inc. (399,543.50), Intercounty Engineering, Inc. (429,755.00), Triple R. Paving, Inc. (432,718.50).
Although Tran Construction was the lowest bidder, their bid documents did not include any of the Federal documents required by Federal Boiler Plate and Broward County requirements.
According to page (3) three of the Federal Grant Department of HUD Boiler Plate For CDBG Projects, all Federal Boiler Plate Required Documents must be completed and submitted with the bid in order for the bidder to be considered responsive. Taking this into account, Broward County confirmed that Tran Construction was not considered responsive.
As a result, Miguel Lopez Jr., Inc. is the lowest responsive, responsible bidder.
Due to very competitive bids, Miguel Lopez Jr., Inc. bid of $269,453.00 is $81,322.75 below the available funding of $350,770.75. Broward County has advised that should staff want to expand the project to utilize the remaining funds, the project would have to be rebid. Due to time constraints associated with all CDBG funded projects, staff will not be able to expand the current project and utilize these funds for the 35th Year CDBG Public Works Improvement Project. However, Broward County has agreed to reallocate these additional funds ($81,322.75) for the 36th Year CDBG Public Works Improvement Project, in addition to the funds that would have already been awarded.

Miguel Lopez Jr., Inc. successfully completed the 34th Year CDBG Public Works Improvement Project for the City of Hallandale Beach in November 2009. This company also completed an emergency asphalt repair along State Road A1A directly after a water main break, and re-paved an alley (after a water main upgrade) within the City of Hallandale Beach. During each of these projects, their company has proven to be reliable, professional, and one that provides quality work.
In addition, Miguel Lopez Jr., Inc. is currently working on paving, concrete and infrastructure improvement projects for the following locations: City of Fort Lauderdale, Cooper City, FDOT, City of Ft. Lauderdale, and the Royal Harbor Yacht Club. The firm’s references further verify that Miguel Lopez Jr., Inc. continues to demonstrate excellent work.
Staff is recommending the City Commission to:
1. Authorize award of Bid #FY 2009-2010-004, 35th Year CDBG Public Improvement Project, to lowest responsive responsible bidder, Miguel Lopez, Jr., Inc. in the total amount of $269,453.00;
3. Authorize City Manager to establish accounts and make expenditures to
implement the 35th Year CDBG Public Works Improvement Project.
