SUBJECT: An Ordinance Of The City Of Hallandale Beach, Florida, Amending Chapter 32, Article IV Of The Zoning And Land Development Code, Division 17, Signs, Relative To Political Signs, Providing For Conflict, Severability And An Effective Date. (Second Reading) CAD #022/03
PURPOSE
City Commission to adopt an Ordinance on Second Reading amending Chapter 32, Article IV of the Zoning and Land Development Code relative to Political Signs.
BACKGROUND:
On September 23, 2009 the Planning and Zoning Board/Local Planning Agency unanimously recommended approval of a political sign ordinance. At the October 21, 2009 City Commission meeting, the City Commission approved on First Reading the political sign ordinance with amendments.
DISCUSSION
Pursuant to Commission directive at the October 21, 2009 meeting, staff revised the political sign ordinance (see attached) as follows:
· Lines 46-48, reworded to now read: “Be securely affixed to a vehicle by a magnetic or similar type material which cannot be easily be removed, provided the sign is in compliance with this subsection.”
3). Exemption from bond requirement.
Any candidate who has filed a qualifying fee petition pursuant to F.S. 99.095 or an affidavit pursuant to F.S. 99.093, shall be exempt from the requirement of posting the bond, provided however, that if the City removes or adjusts the candidate’s sign due to noncompliance, the candidate shall be responsible for payment to the City of its cost and expense of removal or adjustment of the sign.
RECOMMENDATION:
The City Commission adopt the attached Ordinance as amended on Second and Final Reading.
