SUBJECT:     An Ordinance of the City of Hallandale Beach, Florida, Approving and Authorizing a Contract Lease of up to 90,000 square foot portion of City owned property to Broward County for Library purposes (First Reading)

 


PURPOSE:

 

To adopt on First Reading an Ordinance Approving and Authorizing a Contract Lease of up to 90,000 square foot portion of the City owned property to Broward County for Library purposes. 

 

BACKGROUND:

 

The City entered into a lease agreement with Broward County in 1979 for a 20 year term from October 1, 1979 through September 30, 2009. This agreement is for the library located next to City Hall on the Annenberg Tract, which is owned by the City. The library was built as a joint project between the City and Broward County in order to serve the needs of the community.

 

During review of the lease agreement, as related to the requirements and obligations of the City and Broward County, by City Clerk it was discovered that the agreement was to terminate on September 30, 2009. The City Clerk brought this to the attention of the City Manager, so that the appropriate action could be taken to ensure the needs of the community would continue to be met.

 

DISCUSSION

 

Section 5.01(4)(f) Ordinances and Resolution of the City Charter and Section 23-32(a) Leases and Franchises of the City Code of Ordinances, requires that leasing of City Public Grounds be authorized by Ordinance.

 

It is in the best interest of the citizens of the City of Hallandale Beach to provide the library services. Therefore, staff recommends that the City grant authority for the lease of space to Broward County through the adoption of the attached Ordinance. The term of the lease agreement is from October 1, 2009 through September 30, 2029.

 

RECOMMENDATION:

 

City Commission to:

 

  1. Pursuant to Section 5.01(4)(f) Ordinances and Resolution of the City Charter and Section 23-32(a), Hallandale Beach Code of Ordinances, the City Commission approve an Ordinance on First Reading and to set Second Reading for September 2, 2009; and

 

  1. Authorize the City Manager to execute the all documents necessary to implement the lease agreement.
