SUBJECT: An Ordinance of the City of Hallandale Beach, Florida, Adopting and Enacting a New City Code; Repealing Certain Ordinances Not Included Therein; Providing for a Penalty for the Violation Thereof; Providing for the Manner of Amending Such Code; and Providing When Such Code and this Ordinance Shall Become Effective (First Reading)
PURPOSE:
To adopt on First Reading an Ordinance enacting the Republished Code of Ordinances.
BACKGROUND:
The City Commission adopted the current Code of Ordinances by Ordinance on September 4, 2001. In 2008, the City Commission directed staff to update the current Code of Ordinances. The City Clerk’s Office contacted Municipal Code Corporation and entered into an agreement to republish the City’s Code of Ordinances and Charter in its entirety.
DISCUSSION
The City Clerk’s Office has been coordinating the republication of the Code with Municipal Code Corporation. During the process of review of the proofs received from Municipal Code Corporation staff discovered additional amendments and modification in the code that required updating. These additional amendments and modification included updating the list of City Officials, correcting the reference to the South Florida Building Code to the Florida Building Code with Broward County Administrative Provisions, changing references to the Occupational Licenses to Business Tax Receipt, changing references of the Code Enforcement Board to Special Magistrate, ensure references in the Code to the Charter are correctly cited, ensure references to other sections of the Code are properly cited and other administrative corrections.
It is important to note the Code of Ordinance contains only Ordinances that amend, add or delete provisions in the City’s Code. Examples of Ordinances not included are: Adoption of the Annual Budget, Applying of the Planned Overlay District, Amendments, Corrections or Additions to the City’s Comprehensive Plan, and Rezoning of Property. This is consistent with other Cities.
Printing of the republished Code of Ordinances is anticipated to be completed within 60 days of adoption of the Ordinance attached. Ordinances subsequently adopted will be placed on internet for the public to access. The proof of the Code of Ordinances is attached for your reference.
RECOMMENDATION:
The City Commission adopt the Ordinance on First Reading and Set Second Reading for April 1, 2009.
