SUBJECT:   Applications # 79-08-CU, #78-08-V, and #23-09-CL by Eduardo and Karla Nunez, Owners, Chapultepec Restaurant

 

 


PURPOSE:

 

To approve applications # 79-08-CU, #78-08-V, and #23-09-CL by Eduardo and Karla Nunez, Owners, Chapultepec Restaurant for a Conditional Use, Variance, and Nightclub License in order to operate and serve alcohol until 4:00 a.m. on Friday and Saturday nights at the property located at 23 N.W. 2nd Avenue.

 

BACKGROUND/DISCUSSION:

 

The applicants are requesting a nightclub license to operate and serve alcohol until 4:00 a.m. on Friday and Saturday nights, pursuant to Section 32-160(c)(4) of the Zoning and Land Development Code, which conditionally permits nightclubs provided they are located at least 300 feet from any residentially zoned property or use.

 

The applicants are requesting a variance from the 300 foot requirements as the subject property shares a property line with a residentially used lot; although, the single family home is considered non-conforming as the zoning is Business General. The Planning and Zoning Board recommended approval of these applications at the January 28, 2009 meeting with a (6-0) vote, subject to the following conditions:

 

  1. The applicants shall only operate until 4:00 a.m. on Friday and Saturday nights;
  2. The applicants shall be required to hire an off-duty detail at the subject property from midnight to closing;
  3. The applicants shall be required to resod the property and install a continuous landscaped hedge around the perimeter of the property;
  4. The applicants shall be required to restripe all parking spaces as necessary; and
  5. The applicants shall be required to provide paved access to the 9 parking spaces at the rear of the property and install an underground drainage system if required by the City Engineer.

RECOMMENDATION:

 

The City Commission approve applications #79-08-CU, #78-08-V, and #23-09-CL to operate and serve alcohol until 4:00 a.m. on Friday and Saturday nights at 23 N.W. 2nd Avenue subject to the conditions stipulated in this memorandum.
