SUBJECT: Application # 24-09-TC (City Initiated) Ordinance Amending Expiration of Development Approvals CAD# 010/08

PURPOSE:

To amend Section 32-790 of the Land Development and Zoning Code to include a provision that addresses Minor Development, Major Development, and Conditional Use approval expirations during the pendency of litigation.

BACKGROUND:

At the March 5, 2008 meeting, the City Commission approved Ordinance #08-20 amending Section 32-790 to extend the approval deadlines of projects.

DISCUSSION:

Staff is proposing to further amend the language in Section 32-790 to exempt site plans approvals from the time limits during the pendency of litigation. A complete analysis is provided in the Planning and Zoning Board staff report (see backup).

The Planning and Zoning Board, at their January 28, 2009 meeting, recommended approval of the Ordinance with a vote of (6-0)

RECOMMENDATION:

Staff recommends the City Commission adopt on First Reading the attached ordinance and schedule Second Reading for March 4, 2009.
