SUBJECT:      Police and Fire Pension Ordinance – Second Reading Adoption

 

 

 


PURPOSE:

 

To adopt on Second and Final Reading an Ordinance that will implement the Police and Fire Collective Bargaining Agreement (CBA) pension changes from FY 2005-08 into the Pension Ordinance.

 

BACKROUND:

 

The City Commission ratified the Police and Fire Collective Bargaining Agreements on March 7, 2006 and October 3, 2006 respectively.  Both CBA’s contained pension related changes that require the revision of Police and Fire Pension Ordinance 2004-09.  The revised ordinance was prepared by the Pension Attorney and was reviewed by the City Attorney and the Pension Board.  The Ordinance was approved by the City Commission for first reading on May 9, 2008.  The Police and Fire Pension Board then directed the pension actuary to complete the required Actuarial Impact statement prior to the final adoption of the ordinance.  

 

The Actuarial Impact statement dated August 19, 2008 was presented to the Pension Board and the City Commission at their meetings held on August 25, 2008 and November 17, 2008, respectively...  Prior to the adoption by the City Commission, the Pension Board shall affirm to the State Division of Retirement that the Actuarial Impact statement reflects the estimated cost of the proposed amendments and that the proposed changes are in compliance with Part VII, Chapter 112, Florida Statutes and Section 14, Article X of the Florida State Constitution.   This requirement is currently in process and will be completed and verified by staff prior to City Commission meeting on November 19, 2008.

 

DISCUSSION:   

 

The attached Ordinance was prepared by the Pension Board attorney with edification by our City Attorney and reflects only the negotiated benefits from the CBA’s.    Additionally, Article III, section 3.02 reflects the original approved State Statute language related to the Board appointees by the City Commission.   This provision has been further clarified with the adoption of Ordinance 2008-18 which provides for the appointment of City Commissioners as Board members.  

 

 

 

RECOMMENDATION:

 

Staff recommends adoption of the attached Ordinance on Final Reading.
