SUBJECT:     Consideration of Amending Code Section 14-46 (b), Maintenance of Private Stormwater Management Facilities   CAD# 024/08

 

 


PURPOSE: 

 

To consider creating a new sub section (6) to Section 14-46 (b), Maintenance of Private Stormwater Management Facilities of Chapter 14, Minimum Property Maintenance and Occupancy Code, of Article II. Standards, to allow the City to exercise its option to contract or otherwise accomplish the cleaning of the storm drain of a private stormwater management facility that is not being properly maintained by the property owner.

 

BACKGROUND/DISCUSSION: 

 

In an effort to ensure flooding throughout the City is reduced to the greatest extent possible, on September 6, 2006 the City Commission adopted an Ordinance amending the Code to add Section 14-46 requiring maintenance of private stormwater management facilities by property owners.  The City continues to face the problem of flooding due to improperly maintained private drainage systems.  In order to further reduce flooding problems due to the lack of maintenance of private storm stormwater management facilities, staff recommends exercising the option of having the drains of private stormwater management facilities cleaned after the owner has failed to follow the requirements of Section 14.46.  Further, the property owner would be charged for the cleaning service.  Item (6) will read as follows:

 

(6) Following the first penalty of $500, assessed under subsection 14-46(b)(5), the City may exercise its option to have storm drains of the stormwater management facility cleaned and charge the owner for the cost of said cleaning.

 

If approved, the amendment to section 14-46(b) would be placed on the agenda for First Reading when ready.

 

 

 

 

 

 

 

 

 

 

 

 

RECOMMENDATION: 

 

The City Commission consider an amendment to Section 14-46(b) of the City Code whereby the City is empowered to exercise its option to have the drains of private stormwater management facilities cleaned after the owner has failed to follow the requirements of Section 14-46(b)(5).
