SUBJECT:     Application #45-08-CU for a Conditional Use Permit to Operate a Day Care Center at 120 SE 4th Ave.

 


PURPOSE:

 

To approve Application #45-08-CU for a Conditional Use Permit to operate a Day Care Center at the property located at 120 SE 4 th Avenue.

 

BACKGROUND:

 

The applicant, Anne Cartier, has applied for a conditional use permit in order to operate a day care center from a multi-family property located in a residential two-family zoning district. Day care centers are conditionally permitted in RD-12 districts provided that:

-          the area designated for outdoor play is effectively screened from any adjacent residential use, and

-          the facility complies with the criteria listed in the Section 32-964, Conditional Uses, of the City’s Zoning and Land Development Code.

 

Staff has reviewed the plans for the proposed facility and the applicant has met all of the listed requirements.

 

DISCUSSION

 

Attached is the Planning and Zoning Board Memo from the June 25, 2008 meeting which provides the technical and policy analysis.  

 

The Planning and Zoning Board recommended approval of the application by a majority vote of (4-0). Summary minutes of the meeting are attached for your review.

 

 

 

 

 

 

 

 

 

 

 

 

 

 

RECOMMENDATION:

 

The City Commission consider the applicant’s request for a Conditional Use Permit to operate a Day Care Center at the property located at 120 SE 4th Avenue.
