SUBJECT: Application #49-08-CU for a Conditional Use Permit and Application #50-08-V for a Variance to Operate an Assisted Living Facility at 813 NE 2nd Court.
PURPOSE:
To approve:
- Application #49-08-CU for a Conditional Use Permit to operate an Assisted Living Facility at the property located at 813 NE 2nd Court, and
- Application #50-08-V for a Variance allowing tandem parking at the subject property.
BACKGROUND:
The applicant, Andreea Barlacu has applied for a conditional use permit and a variance in order to operate a Level 1A assisted living facility from a single-family home. Assisted living facilities are conditionally permitted in residential single family zoning districts provided that the facility complies with the development standards listed in the Section 32- 525 of the City’s Zoning and Land Development Code. Section 32-523 defines a Level 1A as 8 or less residents and no greater than one staff person. Staff has reviewed the plans for the proposed facility and the applicant has met all of the listed requirements.
Additionally, Florida Statutes 419 “Site selection of community residential homes” subsection 2 stipulates the following:
“Homes of six or fewer residents which otherwise meet the definition of a community residential home shall be deemed a single-family unit and a noncommercial, residential use for the purpose of local laws and ordinances. Homes of six or fewer residents which otherwise meet the definition of a community residential home shall be allowed in single-family or multifamily zoning without approval by the local government, provided that such homes shall not be located within a radius of 1,000 feet of another existing such home with six or fewer residents. Such homes with six or fewer residents shall not be required to comply with the notification provisions of this section; provided that, prior to licensure, the sponsoring agency provides the local government with the most recently published data compiled from the licensing entities that identifies all community residential homes within the jurisdictional limits of the local government in which the proposed site is to be located in order to show that no other community residential home is within a radius of 1,000 feet of the proposed home with six or fewer residents. At the time of home occupancy, the sponsoring agency must notify the local government that the home is licensed by the licensing entity.”
The variance being requested is to allow tandem parking for 2 of the required 4 parking spaces in order to maintain the appearance of a single-family home.
DISCUSSION
Attached is the Planning and Zoning Board memo from the June 25, 2008 meeting that provides the technical and policy analysis. Several residents were in attendance at the meeting to express their concerns regarding the proposed assisted living facility. Attached are the minutes from that meeting, letters from neighbors, and a neighborhood petition.
The Planning and Zoning Board recommended approval of both applications with a majority vote of 3-1 (Cooper-no). Summary Minutes of the meeting are attached for your review.
RECOMMENDATION:
The City Commission consider the applicant’s request for a Conditional Use Permit and a Variance to operate an assisted living facility at the property located at 813 NE 2nd Court.
