SUBJECT:     Ordinances Applying the Planned Development Overlay Zoning District and Rezoning the Property Located at 112 NW 3rd Avenue Known as the Highland Park Village Property

 

 


PURPOSE:

 

To adopt on Second Reading two Ordinances that will (1) apply the Planned Development District (PDD) overlay zoning district and (2) change the zoning on the subject property from RD-12 to RM-25.

 

BACKGROUND:

 

The Planning and Zoning Board recommended approval of the attached Ordinances by a vote of 5-0.  The minutes of the hearing are attached as part of the backup material.  These were prepared as action minutes and precede the City Commission directive for summary minutes.

 

The City Commission at the April 16, 2008 meeting approved on First Reading the attached Ordinances.  Additionally, the City Commission approved the associated Major Development application (site plan) including the assignment of 23 Residential Reserve Units for Highland Park Village project.  At the hearing the City Commission directed the City Manager to finalize negotiations with the applicant and bring back the proposed Development Agreement when ready.  Attached for City Commission consideration is the finalized proposed Development Agreement with the Developer.

 

DISCUSSION

 

Attached is the staff report prepared for the First Reading of this item that includes both the policy and technical analysis.

 

 

 

 

 

 

 

 

 

 

 

 

RECOMMENDATION:

 

Staff recommends adoption of the attached Ordinances on Second Reading. In addition, the City Commission is requested to authorize the City Manager to execute the finalized Development Agreement.
