SUBJECT:     An Ordinance of the City of Hallandale Beach, Florida, Amending Chapter 23, Section 23-105, "Award of Contract" of the Code of Ordinances by Clarifying the Award of Contracts to the Lowest Responsive, Responsible Bidder and by Enacting Regulations Governing the Involvement of the City Commission in the City's Purchasing Process. (Second Reading) CAD# 033/07

 

 


PURPOSE:

 

To adopt the Ordinance on Second Reading clarifying the award of contracts to the lowest responsive, responsible bidder and by enacting regulations governing the involvement of the City Commission in the City’s Purchasing Process.

 

BACKGROUND/DISCUSSION:

 

On April 2, 2008 the City Commission adopted the Ordinance on First Reading with an amendment, as appropriate, that would enable the City to complete projects subject to formal, competitive bids by using “in-house” forces.  This amendment was intended to specify that the City can complete projects, including maintenance and repair activities, “in-house” subject to a determination that costs are unreasonable or bids submitted by private contractors are not responsive.   This amendment was further recommended in light of House Bill 683/Senate Bill 2148 which would have significantly curtailed the use of municipal and county forces to self perform construction work, including maintenance and repair activities.  

 

The bills proposing greater restrictions regarding self performing of construction work were not passed by the Legislature.  Further, existing State Statutes do not preclude the City from completing projects subject to competitive bidding procedures with “in-house” forces when the City does not receive any responsive bids, or a determination is made that costs are unreasonable. All procurement will be in accordance with Purchasing Code as implemented by administrative policy and procedures.

 

Accordingly, no additional changes are recommended in the Ordinance language from that presented for First Reading on April 2, 2008.

 

 

 

 

 

 

 

RECOMMENDATION:

 

The City Commission adopt the Ordinance on Second Reading and authorize the appropriate officials to execute.
