MOTION TO CONSIDER AND APPROVE:
Application #57-11-AV by Wal-Mart Stores East, LP Requesting an Alcoholic Beverage Variance from Section 5-6(b)(2) of the City's Code of Ordinances in order to sell beer and wine for consumption off-premises within 600 feet of another establishment licensed to sell beer, wine and liquor at the property located at 2551 E. Hallandale Beach Blvd.
Why Action is Necessary
Section 5-6(b)(2) of the City's Code of Ordinances states no establishment shall sell beer, wine and liquor for consumption off-premises within 600 feet of another establishment licensed to sell beer, wine and liquor. The applicant (Wal-Mart) currently has a license to sell beer only for consumption off-premises which is not subject to the 600 foot distance requirement; however, they wish to increase their alcohol beverage license to include the sale of wine. There is an existing liquor store (Goldstar Liquors) at 2511 E. Hallandale Beach Blvd. which is in the same shopping plaza as Wal-Mart. The establishment is 165 feet away from Wal-Mart when measured by the most direct route from the main entrance to the main entrance; thus, a variance is required.
What Action Accomplishes
Approval of this application will allow the applicant to operate a grocery and food retail operation with liquor package sales (beer and wine only) within the required 600 foot distance separation from another establishment selling alcoholic beverages.
Is this Action Goal Related
This action specifically addresses the City’s strategic priority for Economic Development by supporting business owners in maintaining and improving property values and providing a sustainable community with a healthy balance of residential, commercial and light industry that provides a mix of local employment opportunities.
Previous Action Taken
On November 17, 2010 the City Commission approved the Major Development application #66-09-DB by Wal-Mart Stores East, LP to construct a 22,210 square feet addition to the existing store. Building permits have been issued for the expansion and construction is underway.
Summary Explanation/Background
STAFF RECOMMENDS APPROVAL OF THE ABOVE MOTION.
Wal-Mart is currently expanding their existing building by 22,210 square feet to accommodate additional grocery and food retail sales. To better service their customers, Wal-Mart is requesting to increase their alcohol beverage license from a 1APS (beer sales only with off-premise consumption) to a 2APS (beer and wine sales with off-premise consumption). There will be no consumption of alcohol on the premises.

The Police Department has advised they have no objections to the approval of the subject application.

Fiscal Impact/Cost Summary:
Approval of the subject application will generate an estimated revenue of $196 in Business Tax Receipt fees for the City.
